These Terms of Service ("Terms") govern your access to and use of Psyth (the "Service"), operated by Psypher AI ("Psypher", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must provide accurate information when creating an account and are responsible for activity under your account. You must be at least 16 years old to use the Service.
2. Your content
You retain all rights to the content you upload or create in the Service ("Customer Content"). You grant Psypher a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely as needed to provide and improve the Service.
3. Acceptable use
You agree not to:
- Violate any law or infringe any third party's rights.
- Send malicious code or attempt to disrupt the Service.
- Reverse engineer or circumvent security controls.
- Use the Service to build a competing product or benchmark against competing products without written permission.
- Misuse AI features to generate harmful, illegal, or deceptive content.
4. Plans, billing, and trials
Paid plans auto-renew at the end of each billing period unless cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice, effective at the start of the next billing period.
5. Beta features
Parts of the Service are offered in beta. Beta features are provided "as is", may change or be withdrawn, and may have reduced availability or support.
6. Intellectual property
Psyth, including its software, design, and documentation, is owned by Psypher and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-transferable license to use the Service.
7. Third-party services
The Service may integrate with third-party services. Your use of those services is governed by their own terms, not these Terms.
8. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, or to comply with law. You may cancel at any time from your workspace settings.
9. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Psypher shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability arising out of or relating to these Terms is limited to the amounts you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold Psypher harmless from claims arising out of your Customer Content, your use of the Service in violation of these Terms, or your violation of any law or third party right.
12. Governing law
These Terms are governed by the laws of the jurisdiction where Psypher AI is incorporated, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, except where mandatory consumer-protection laws apply.
13. Changes
We may update these Terms. Material changes will be announced via the Service or email. Continued use after changes take effect constitutes acceptance.
